Study: AI targeting system providers may face criminal liability

An ICRC blog post examines whether executives of AI targeting system providers could face criminal liability under international law when their systems contribute to serious IHL violations. The author cites Article 25(3)(d)(ii) of the Rome Statute and the Katanga test, arguing that providing systems with knowledge of a group's criminal intent could constitute complicity. The Tesch case, involving a businessman convicted for supplying poison gas, is used as a precedent.
